The judge of the District Administrative Court of Kyiv, Oleksandra Brahina, was served with charges

NABU and SAPO served Oleksandra Brahina, the judge of the District Administrative Court of Kyiv, with charges regarding her deliberate failure to submit a 2020 electronic declaration. Her actions were qualified under Art. 366-3 of the Criminal Code of Ukraine.

Judge Oleksandra Brahina refused to submit electronic declarations, citing the lack of an electronic signature and her religious beliefs. At the same time, judge Brahina passed dozens of court decisions every day and signed them… with an electronic signature.

Then NACP refused to accept such a declaration, referring to the Law of Ukraine “On Prevention of Corruption”. After that, Brahina filed a lawsuit against NACP in the DACK, as a result of which judge Arsiriy obliged NACP to accept Brahina’s paper declaration. NACP immediately appealed this decision in the сourt of appeal.

Later, the Sixth Court of Appeals recognised that NACP legally refused to accept Oleksandra Brahina’s declaration in paper and not in electronic form. Paper declarations make it difficult for the public to get to know the property and lifestyle of officials and judges, which is why e-declaration is critically important.
