The Council of Judges has no plans to appoint new Constitutional Court judges?

Time passes, yet there are still no judges for the Constitutional Court appointed by the Congress of Judges. It seems there won’t be any in the near future. According to our colleagues from the AntAC, the Council of Judges does not plan to announce the convening of the Congress of Judges of Ukraine to address this issue.

Currently, there are 13 out of 18 judges in the Constitutional Court. By law, it can only function if it has at least 12 judges. Thus, due to the Council of Judges’ delays, the work of the Constitutional Court might be blocked.

Previously, the G7 Ambassadors urged the Congress of Judges to convene and appoint a judge of the Constitutional Court. However, this call seems to have been ignored.

These delays are unacceptable, though not surprising given who heads the Council of Judges. Monich is one of the figures implicated in the “Vovk’s tapes.” He has publicly defended the judges of the District Administrative Court of Kyiv and actively sabotaged the creation of the Ethics Council with international experts. The Council of Judges’ leadership, along with their colleagues, is accustomed to placing their assosiated in key positions behind closed doors, without foreign involvement.

The Council of Judges once again reveals its true nature, raising the question of its continued existence. Draft law No. 8342 could solve this problem by providing for the dissolution of the Council of Judges as a self-governing body and transferring its powers to the High Council of Justice. However, this draft law has yet to be passed.
